Nominees

If you are a broker, bank, or other nominee who performed trades for the beneficial interest of a person or entity other than yourself who meets the Settlement Class definition set forth in the Notice, WITHIN SEVEN (7) BUSINESS DAYS OF YOUR RECEIPT OF THE NOTICE you must either

  1. Provide to Epiq Class Action & Claims Solutions, Inc. (“Epiq” or the “Settlement Administrator”) the name and last known address of each person or organization for whom or which you made Swiss Franc LIBOR-Based Derivatives transactions during the Class Period ; or
  2. Request from the Settlement Administrator sufficient copies of the Notice to forward directly to beneficial owners of the Swiss Franc LIBOR-Based Derivatives transactions. Request from the Claims Administrator sufficient copies of the Notice and Claim Form to forward to all such beneficial owners, and within seven (7) business days of receipt of those Notice Packets forward them to all such beneficial owners

PLEASE NOTE: These documents contain deadlines that could impact your customers’ rights.

If you are providing a list of names and addresses to the Claims Administrator:

  1. Compile a list of names and addresses of the beneficial owners that purchased, sold, held, traded, or otherwise had any interest in Swiss Franc LIBOR-Based Derivatives during the Class Period.
  2. Prepare the list in Microsoft Excel format. A preformatted spreadsheet can be found by clicking here.
  3. Then you must do one of the following:

    1. Burn the Microsoft Excel file(s) to a CD or DVD and mail the CD or DVD to:

      Portland, OR 97228-5585
      U.S.A.

    2. Email the spreadsheet to info@SwissFrancLIBORClassActionSettlement.com; or
    3. Upload the spreadsheet here.

If you are mailing the Notice Packet to beneficial owners:

If you elect to mail the Notice and Claim Form to beneficial owners yourself, additional copies of the Notice Packet may be requested via email to info@SwissFrancLIBORClassActionSettlement.com. If you are providing the Notice and Claim Form to beneficial owners, the mailing must be completed within seven (7) business days of your receipt of the Notice and Claim Form from the Settlement Administrator. Failure to timely forward the Notice and Claim Form to beneficial owners may affect their legal rights. If you are restricted from disclosure under any applicable domestic or foreign data privacy, bank secrecy, state secret, or other law, then Plaintiffs’ Counsel requests that you provide this Notice directly to any of your customers that are Settlement Class members if permitted to do so by such applicable rules and laws.
